Thank you so much for trusting Smart Cookies Bay Area to create something special for your event. Your support is very important to grow my small business. Please review all Terms of Service to ensure we have a smooth transaction. I would like to have an easy transaction and be as transparent as possible.

Custom Cookie Flavors and Designs
All custom orders have a minimum of 2 dozen custom cookies with a base price of $55/dozen.
Final prices are dependent on the design and on the tier they fall under. Examples can be found at the Pricing page.
Special/seasonal flavors have a minimum of 2 dozen for both cookies and icing.
Puzzles and platters have a minimum of 1 dozen with a base price of $50/dozen.

I will follow the Client’s requests closely to create the designs desired. All cookie designs will be communicated with the Client when finalizing the order and prior to payments rendered.
Smart Cookies Bay Area cannot duplicate an exact copy of another artist’s work but will ensure the finished products work for the theme, occasion, and requests to the best of my abilities. It is best to send an invitation, décor examples, or other general ideas for inspiration.
Icing colors may vary. I'll do my best to match the colors as close as I can, but colors can vary based on many reasons outside of my control. Placing an order with me means that you agree that the colors may vary from inspiration photos and invitations.
I do my absolute best to match themes, colors and requested details. As my products are handcrafted, there may be slight variations.
I cannot replicate any copyright images, but we can discuss other ways of applying your theme to your cookies.
I do not accept any sexually explicit or drug-related orders.
Retainers, Deposits & Payments
All orders require at least 21 days of notice.
If there are multiple requests for the same date, I may not be able to accommodate all requests and orders will be accepted on a first-come, first-served basis.
For large orders (4+ dozen), I ask you give me at least 5 weeks notice so I can get organized and make your cookies as great as possible since I am a one-woman show working in corporate full time. (Please have mercy on me)
All orders require a 50% non refundable deposit. I can only refund up to 24 hours after initial payment is sent. The date of the event is considered “booked” upon receipt of payment and agreement of the Terms of Service.
After 24 hours, all sales are final and no refunds will be given.
If payment is not received within 24 hours after both parties confirm, your order will be automatically cancelled.
The final payment for large orders is due 7 days prior to the pickup date. The Client will receive an email reminder about 10 days prior to the pickup date.
If the Client fails to make payments, Smart Cookies Bay Area will cease work, the order will be canceled and no refund will be given.
Preferred method of payment is Venmo. You will receive account information upon confirmation of your order.
All prices are subject to change, prices are often dictated by the ingredient costs and detail of work. Examples and tiers can be found in the Pricing tab. Please review prior to submitting your request.
Smart Cookies Bay Area will not deliver cookies if payments have not been paid in full.
Postponement Due To COVID-19
If you cannot pickup your order due to a COVID-19 situation, I can freeze your cookies for up to 3 weeks. Please let me know immediately if that is your situation. After 2 weeks, the cookies will no longer be as fresh and you will have to pick up or forfeit the order.
Pick Up
Pickup times are on Saturday from 9:00-11:00 am in Hayward, CA. The exact address and directions will be sent before the pickup date via a confirmation email and calendar invitation.
A new pickup person will be accepted only if the Client who placed the order notifies Smart Cookies Bay Area.
If you do not show up to your pickup time, your order will be forfeited and no refund will be given.
There is no delivery/shipping option at this time.

Packaging
All cookies are individually heat sealed.
Cookies are placed in a bakery box for pickup for a small fee. The Client may opt out and provide a box/container to be used at the time of pickup. If no box/container is provided, an invoice for a bakery box will be issued. If the box/container provided by the Client does not fit all cookies, the Client will be notified and be asked for another container at pickup or be charged the box fee.
The client has the option to supply the box/container prior to pickup for a quicker pickup experience, or to pack up boxes at the time of pickup.
Photographs
Smart Cookies Bay Area reserves the right to use all photographs of the cookies for marketing purposes. If you prefer not to have your order shown online, please let me know at the time of booking.
Liability
Smart Cookies Bay Area is not responsible for any damage to the cookies or shortage of cookies caused by anyone NOT employed by Smart Cookies Bay Area.
The Client assumes liability once the order passes into the Client’s possession. The Client is responsible for providing a suitable environment for the cookies. A suitable environment includes an area away from heaters, a solid surface, and a suitable outdoor setting away from direct sunlight.
Allergy & Dietary Warnings
Smart Cookies Bay Area’s baked goods may contain the following ingredients:
Eggs
Wheat
Dairy
Natural dyes, artificial dyes, artificial flavorings, sugar, artificial sweeteners, artificial color and other allergens not listed.
The Client is responsible for pointing out to guests potential allergy hazards.
Health and Safety
In addition to the health and safety guidelines imposed by the County of Alameda, Smart Cookies Bay Area takes additional steps to ensure the safety of the cookies provided in my kitchen.
All persons who handle ingredients, products, tools, or equipment are required to take a food handler’s certificate and follow its health and hygiene guidelines.
All persons near any ingredients, products, tools, and equipment are required to wear a mask. If someone has long hair, they are required to put it in a bun and/or wrap it with a hair wrap.
No one who has any cold or flu symptoms are allowed near ingredients, products, tools, or equipment related to cookie orders.
Fulfillment of Contract
Smart Cookies Bay Area is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, or any other circumstance beyond Smart Cookies Bay Area’s control.
Once Client picks up the order, Smart Cookies Bay Area no longer assumes any responsibility for damage caused to it.
To avoid damage to cookies, please keep cookies in a cool environment and avoid extreme heat and direct sun. Instructions will be given on freezing and defrosting upon pickup.
